1. Agreement to Terms
By accessing PhonemeLab, you agree to these Terms. If you are a teacher or school administrator, you agree to these terms on behalf of your institution and students.
If you do not agree with these Terms, please do not use our Service.
2. Accounts & Credits
2.1 The Credit System
PhonemeLab operates on a pre-paid credit basis. Credits are purchased in "Packs" and are deducted based on usage (e.g., Standard vs. Premium assignments).
2.2 No Expiration ✓
Purchased credits do not expire as long as your account remains in good standing.
2.3 Refunds
Credits are non-refundable once purchased, except where required by law (e.g., EU 14-day cooling-off period for unused digital goods).
2.4 Dormancy
If an account remains inactive for 24 consecutive months, we reserve the right to archive the data to maintain database performance. We will attempt to contact you prior to any archival.
3. School & District Licenses
3.1 Fair Use Policy
"Unlimited" school licenses are intended for normal classroom usage. We monitor backend usage to prevent abuse.
3.2 The Cap (2,000 Credits/Student/Month)
Usage exceeding 2,000 credits per student/month is considered outside fair use. PhonemeLab reserves the right to throttle or review accounts that consistently exceed this threshold to protect service stability for all users.
3.3 Authorized Users
Licenses are per-seat. Sharing a single teacher account across a whole department is prohibited and grounds for termination.
4. Intellectual Property & AI
4.1 Your Data
You retain ownership of all student recordings and assignment data. You grant us a license to process this data solely to provide the Service.
4.2 No Model Training ✓
We do NOT use your proprietary student audio to train our general-purpose AI models for other customers.
5. Liability & Disclaimer
PhonemeLab is an educational support tool. We do not guarantee specific exam results (e.g., IELTS/TOEFL scores).
The Service is provided "AS IS." To the maximum extent permitted by law, Chamberlin Innovations SASU's liability is limited to the amount you paid us in the last 12 months.
6. Acceptable Use
You agree not to:
- Use the Service to violate any applicable law
- Upload malicious content or attempt to breach our security
- Resell, sublicense, or redistribute the Service without authorization
- Use automated tools to scrape or extract data beyond normal usage
- Impersonate another user or misrepresent your affiliation
7. Account Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time via account settings or by contacting support.
Upon termination, your data will be handled according to our Privacy Policy.
8. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect.
9. Governing Law
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.
